After a long 3 decades, the case of Erik and Lyle Menendez has resurfaced in the media. New evidence on the Menendez brothers’ case has been presented, which could potentially lead to their release.
On the night of August 20, 1989, brothers Erik and Lyle Menendez murdered their parents, Jose and Kitty Menendez, in their Beverly Hills home. Initially, crime scene investigators thought it was a mafia hit or a robbery gone wrong, as there were no immediate suspects. However, after months of investigation, the brothers were arrested.
During the trial, it was revealed that both Erik and Lyle had experienced sexual, physical, and emotional abuse by their father. The brothers claimed they killed their parents in self-defense because they feared for their lives. The defense argued they suffered from “battered child syndrome,” which is a psychological condition caused by prolonged abuse.
Despite the strong testimony of both brothers and family members, the prosecution concluded the murders were premeditated. They pointed to the brothers’ spending after the killings, arguing the motive was financial gain, not self-defense.
The brothers were convicted of first-degree murder and sentenced to life in prison without the possibility of parole.
The Menendez brothers’ case became viral on TikTok in 2020 and other social media sites during COVID-19. The outcome of the case infuriated many teens, who then started to support the brothers. Nowadays, it is easier for individuals, particularly teens, to comprehend that boys can also be sexually assaulted. Erik’s Attorney, Leslie Abramson, asked the jury, “If my client’s name were Erika instead of Erik, would you have an easier time believing his story?”
Months before the murders, Eric wrote his cousin Andy a letter that was discovered in storage but was never shown in court. The resurfacing of this letter has led to a review of the case. In it, Erik reveals his fears for his life. “I’ve been trying to avoid dad. It’s still happening, Andy, but it’s worse for me now. Every night I stay up thinking he might come in. I’m afraid. He’s crazy. He’s warned me a hundred times about telling anyone, especially Lyle.” This piece of evidence helps support the claims that the brothers did not fabricate it as a way to escape punishment.
Jose held an executive role at RCA Records in the 1980s. Roy Rossello, a member of one of the signed bands, recently came forward and accused Jose of sexually abusing him while he was a minor. After the brothers were informed, Lyle commented “When I first heard about it… I cried.” You cannot help but imagine the sense of relief they must feel knowing they could finally be heard.
With fresh evidence and increased attention to the case, the DA strongly recommends the brothers’ cases be retried. The attorneys will fight in support of charging them with the act of manslaughter as opposed to murder. Currently, members of the Menendez family are coming together to advocate for the brothers’ release. Los Angeles County District Attorney George Gascón gave his opinion on the case, stating that he supports the men’s resentencing. The new judge will be sworn in at the start of December. Lyle and Erik’s hearing is scheduled for December 11th.
